1. Instructions on how to claim and the reward form part of these Terms and Conditions. Participation in this offer is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
  2. Claims are only open to Australian residents aged 18 years or over.
  3. Employees (and their immediate families) of the Promoter, Endeavour Group Limited and agencies associated with this offer are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Offer commences on 25/09/2025 and final claims close at 11:59pm AEDST on 04/01/2026 (“Offer Period”).
  5. To be eligible to claim, individuals must purchase a specially marked 750ml bottle of participating wine (“Eligible Product”) from a participating Dan Murphy's or BWS liquor retailer during the Offer Period. Specially marked bottles will contain a promotional neck tag/collar featuring both a QR code (“QR Code”) and a unique promotional code (“Promo Code”). It is the claimant's responsibility to request a purchase receipt, in the event one is not automatically provided to them.
  6. Eligible Products include:

    Freixenet Prosecco DOC 750ml
    Freixenet Italian Sparkling Rose 750ml
    Freixenet Pinot Grigio 750ml
    Freixenet Italian Still Rose 750ml

  7. A participating Dan Murphy's or BWS liquor store is any Dan Murphy's or BWS liquor store in Australia that stocks the Eligible Product and features advertising material relating to this Offer (“Participating Retailer”).
  8. To make a valid claim, individuals must then undertake the following steps during the Offer Period:
    1. Scan the QR Code (or visit Freixenet-eats.com.au and follow the prompts to the claim page;)
    2. Input the requested details (including first name, last name, valid email address, mobile phone number and Promo Code);
    3. Upload a copy of their purchase receipt when prompted;
    4. Check the box agreeing to the Terms and Conditions; and then
    5. Submit the fully completed online claim form.
  9. The Promoter reserves the right, at any time, to verify the validity of claims and claimant's (including a claimant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the offer. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  10. Incomplete or indecipherable claims will be deemed invalid.
  11. Only one (1) claim is permitted per person for the entire duration of the Offer Period.
  12. Claimants must retain both their purchase receipt and their neck tag/collar featuring the Promo Code used to claim the reward as proof of purchase. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of a claimant's claim and forfeiture of any right to a reward. Purchase receipt(s) must clearly specify the product purchased, store of purchase and that the purchase was made during the Offer Period but prior to entry.
  13. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
  14. Every valid claim received will be awarded a $10 Uber Eats Gift Card (“Reward”) sent to claimants via email (to the same email address used to submit their claim). Each valid claimant will only receive one (1) Reward and multiple claims are not permitted.
  15. The Promoter's decision is final and no correspondence will be entered into.
  16. Any ancillary costs associated with redeeming the Uber Eats Gift Card are not included. Any unused balance of the Uber Eats Gift Card will not be awarded as cash. Redemption of the Uber Eats Gift Card is subject to any terms and conditions of the issuer including those specified on the Uber Eats Gift Card. The Uber Eats Gift Card will expire three years from the date of activation. Upon expiration, unused funds will not be refunded or credited. This card is redeemable via the Uber or Uber Eats app within Australia in cities where Uber or Uber Eats is available. The card is non-reloadable and cannot be redeemed for cash, refunded, or replaced, except as required by law, including the Australian Consumer Law. No change will be given. You may be required to add a secondary payment method to use this gift card with the Uber or Uber Eats app. Lost or stolen cards will not be refunded or replaced, so treat this card like cash.   17. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this offer is subject to the licensee's liquor serving policy.
  18. If for any reason a claimant does not redeem a Reward by the time stipulated by the Promoter, then the Reward will be forfeited.
  19. If the Reward is unavailable, the Promoter, in its discretion, reserves the right to substitute the Reward with a reward to the equal value and/or specification.
  20. Rewards, or any unused portion of a Reward, are not transferable or exchangeable and cannot be taken as cash.
  21. If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the offer, as appropriate.
  22. Any cost associated with accessing the offer website is the claimant's responsibility and is dependent on the Internet service provider used.
  23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer.
  24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a Reward.
  25. The Promoter collects personal information ("PI") in order to conduct the offer and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, Reward suppliers. Participation in this offer is conditional on providing this PI. The Promoter will not use PI for any promotional, marketing, publicity, research and profiling purposes unrelated to the offer. Information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with can be found in the Promoter's Privacy Policy, which can be viewed at https://www.henkell-freixenet.com.au/privacy-policy-1 . For the avoidance of doubt, the Promoter will use PI solely for purposes related to this offer and will not use PI for any purpose, detailed in the Privacy Policy, that contradicts this use. All claims become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
